"What do we do with the gecko thing, it seems harmless enough? Anyone want a pet?" Pavro asks, eying the creature dubiously.

The earth elemental moved up onto the chief, there is no way he can make that move without provoking, since even a withdraw would only stop him provoking from one square.
The earth elemental swings twice at the chief who ignores both its attack of opportunity and charge with disdain. Pavro scowling decides he can afford to squander some resources on this smug little git, and simply summons another earth elemental ordering it to attack the chief in Terran, even as the first elemental vanishes.
The new earth elemental charges the chief from the front and slams its earthern fist into him dealing a savage blow to the little goblin,
"Ha, eat fist you cocky little pillock. You aren't raiding anyone again!" Pavro shouts punching the air, even as he ducks behind the pillar furthest from the chieftain.

Pavro then walks over and opens the door that looks likliest to lead toward the front gate of the fortress instructing his earth elemental to move in ahead through the stone and rise up in the center of the room as he does so.

Well I don't really see it as a Summoner problem, many characters have access to the same summons list. The problem is that what seems like a perfectly valid tactic is too great for the creatures CR, I'd argue that that would be true even with the old size caveat, since a medium elemental effectively gets a DC 14 reflex death effect against small characters by engulfing them and flying potentially 300ft up with no more saves - of course the character can try to kill it, but that's not exactly a win either!
Its dealt with easily enough by simply side stepping the problem, which I'm happy to do. Sadly things like this are bound to crop up with such an expansive rule set. *shrugs*

The air elemental chases the shaman down using its speed and maneuverability to counteract the advantages given him by the foliage and strikes from above.
Retcon of elementals actions. I included a higher ground bonus of +1 in the roll and in retrospect am not sure I should have. Do you need to be on ground to have higher ground? An air elemental is probably just as stable, but I can't find any explanatory text. Also including sermanic performance.

Hmmm, its a bit of a pain, and I can definitely see the potential for it being broken with my DM eyes. Fail a reflex save it flies you 100ft up and drops you is potentially devastating and really too powerful for a 2nd level spell equiv.
Its probably easier if we just assume summoned air elementals can't use whirlwind, saves a lot of bother. Its not a tactic I was planning to use I just spotted it in the stat block and thought ooooh!

I would like to argue against that ruling on whirlwind VOW.
There are definite advantages to maintaining a whirlwind and these are the only reason being able to maintain it is relevant.

The air elemental reforms, but simply shifts back in a whirlwind again and goes for the shaman.
Pavro meanwhile casts a daze spell upon one of the goblins and attempts to get behind cover from the archer.
Two DC 14 reflex saves, 1st for slam second for getting picked up by the whirlwind. If it picks him up it uses the remainder of its 100ft. movement to move him straight upwards.
Slam Damage:1d4 + 3 ⇒ (3) + 3 = 6
DC 15 Will or goblin archer is dazed for one round. Not sure how high the tower is spells range is only 30ft. so Pavro may need to move closer to use it.
