So the FBI hacks the marketplace server and seizes all the bit-coins. The Bit-coins themselves were owned by the diverse account holders. That makes the Silk Road a defacto bank so if the FBI are successful they will have set precedent for the raiding of Banks (off shore and on) not just for your illicit funds but for the funds of every account holder.

Bitcoins that anyone owns likely have passed through silk road, and they can follow that through the block chain, but it would be difficult for them to seize bitcoins from say me, as I don't keep them in a bank. I don't think most bitcoins are in banks, which is one of the great things about them. With all of the shutdowns of exchanges and silk road bust, the safest place for your coins is on your pc. (imo)
