We have updated the Paizo Publishing Community Use Policy. The following clauses have been added:
- Should an item be removed from the Community Use Package, you don't need to remove it from existing projects, but you may not use it in future projects.
- You may use the artwork published to illustrate the Web Fiction at paizo.com/pathfinder/tales/serial. Note that the web fiction itself may not be used under this policy—just the artwork.
We have also updated all of the Community Use Packages. Many new items have been added, and images that were JPGs have been converted to PNGs with transparent backgrounds. See the individual item listings for details.

Awesome! Thanks for addressing this. The new packages are great.

You're forgetting that artifacts of that level of power come with drawbacks that are usually worse, much worse, than whatever benefit they purport to provide. Within a year or two you'd turn into a grizzled undead guardian, watching endlessly for the repeated and interminable attacks of estate lawyers, doomed to forever guard the copy machine.
And goodness only knows what would happen when its lease expires.

There actually is no such thing as a Gary Teter Stapler. Whenever he needs to staple some paper he walks over to my desk and steals mine.
I think he has a crush on me or something because while Cosmo and Vic's desks are closer, he always walks around to my desk to steal my stapler.
Well, considering he is the Lord of All Code, and will likely one day be the planet's Digital Overlord, I'd stay on his good side if I were you.

Oh, he knows what happens to people who touch my stapler. That's why one Paizo employee has to present a special card when he walks through the airport metal detector.

Thanks for the update to the Community Use Policy!
However, I do have a question about the policy....
If you are producing a website under the Community Use Policy, is it OK to reference material from the Community Use Approved Product List in conjunction with material from third-party publishers released under the Pathfinder Compatibility License?
And what about OGC from non-Pathfinder sources? For example, could you convert Open Game Content from 3.5 sources for use in Golarion? Is this OK (provided that the updated material is based upon OGC - I'm not suggesting converting WoTC intellectual property or anything like that)?

We can't give you permission to do *anything* with third-party IP, as—by definition—we don't own it. You'd need to get permission from them. Assuming you get that permission, there's nothing in the CUP that would prevent you from doing that. (Though I would note that carefully attributing the exact stuff to the right people would be nice.)

We don't stop you from doing anything the OGL would let you do.

Cool. That answers my question. There's nothing preventing me from using Pathfinder-compatible OGC produced by third-party publishers with material on the Community Use Approved Product List. Awesome!

So it is OK to use existing OGC under the CUP and still claim compatibility with the Pathfinder RPG? This seems to allow non-commercial adaptation of 3.5 OGC to the Pathfinder setting in a way that is compliant with Section 7 of the OGL:
7. Use of Product Identity: You agree not to Use any Product Identity, including as an indication as to compatibility, except as expressly licensed in another, independent Agreement with the owner of each element of that Product Identity. You agree not to indicate compatibility or co-adaptability with any Trademark or Registered Trademark in conjunction with a work containing Open Game Content except as expressly licensed in another, independent Agreement with the owner of such Trademark or Registered Trademark. The use of any Product Identity in Open Game Content does not constitute a challenge to the ownership of that Product Identity. The owner of any Product Identity used in Open Game Content shall retain all rights, title and interest in and to that Product Identity.

Nothing in the *Community Use Policy* allows you to claim compatibility under OGL section 7, but so long as your Community Use project is a book, an electronic book, or a freely available website, (and you meet all the other stated requirements) you may *also* use the Pathfinder Roleplaying Game Compatibility License, which *does* allow you to claim compatibility under Section 7.

This post is pleasantly amusing in hindsight =)
