APG Spell: Thundering drums

I'm a bit confused by the wording on the spell thundering drums.

It states that the spell does 1d8 dmg per caster level to a max of 5d8 - since it's a third level bard spell, you have to be at least 7th level to cast it, capping the damage from the get-go. So why not just write "target takes 5d8 dmg"?

Is this a typo or is there some deeper thought behind this?

There is a meta-magic feat (Intensified Spell) that ups any level-cap on damage by 5 levels. A 10th level bard with that feat could cast it as a fourth level spell and do 10d8 with it.
