Doooesn't quite work.Also:
(5) administering to that other person by force or threat of force, or without the knowledge or consent of that person, a drug, intoxicant, or other similar substance and thereby substantially impairing the ability of that other person to appraise or control conduct;
is guilty of rape and shall be punished as a court-martial may direct.[5]what if the person get drumk by him/her-self?
would it be ok for the other person to take advantage of the situation?
It does sound like sexual assault though.

I did read what I posted. Did you?
I bolded the relevant part of Lord Snow's provided definition, but maybe bolding wasn't enough. Here, let me isolate it for you:
"administering to that other person [...] without the knowledge or consent of that person [...] is guilty of rape and shall be punished as a court-martial may direct."
I do believe Hama had no knowledge of what was going on at the time and gave no consent.

Yes, he wasn't aware, but if you read that whole line "administering to that other person by force or threat of force, or without the knowledge or consent of that person, a drug, intoxicant, or other similar substance and thereby substantially impairing the ability of that other person to appraise or control conduct; ", it doesn't apply.
That's for slipping someone a date rape drug. No such "drug, intoxicant or other similar substance" was administered to Hama without his knowledge or consent.
This particular law does not appear to cover committing a sexual act on someone who is unconscious or impaired, unless you also render them unconscious or impair them. That's a flaw with this law, not a claim that the behavior was acceptable.

EDIT: Oh yeah, I'm a guy. 100% straight. I had it proven by a very frustrated male masseuse who had to call in a female colleague. Long story.
Holy crap am I reading this right? I have heard that in some countries massages end that way and it is considered completely non-sexual but somehow I guess I assumed the masseuse was always opposite sex.

Yeah, long story short, i had some water accumulated in the nether regions and the only way to really move it somewhere else where it would go away more easily and leave me less bloated is for the masseuse to induce an erection. The guy really grew frustrated. Said it never happened to him before. So he had to call in a female colleague. She managed. It's actually physical therapy. Because I'm a bit fat, and after exercising for a while, I get water in the regions where I burned the fat away. So it has to be squeezed out.
